Changes to Terms
We reserve the right to change or modify these Terms at any time and in our sole discretion. If we make changes to these Terms, we will provide notice of changes, such as by sending an email notification, providing notice through the Sites or updating the “Last Updated” date at the beginning of these Terms. By continuing to access or use the Sites or order, receive or use Products, you confirm you acceptance of the revised Terms. We encourage you to review the Terms to ensure that you understand the terms and conditions that apply when you access or use the Sites or when you order, receive or use the Products. If you do not agree to the revised Terms, you. May not access or use the Sites or order, receive or use the Products.
Simply Rawsome and its information including our website (simplyrawsomeus.com) and our Facebook pages Simply Rawsome Community and Simply Rawsome is not intended to replace a veterinarian but only to provide an avenue to educate. Simply Rawsome is not responsible for pets that may become ill and urges its raw feeders and their companions to practice proper cleaning and sanitation practices as well as proper storage. We assume no responsibility or liability for the use of the information contained on our website or Facebook pages. If you have any concerns about your pets health, please contact your holistic veterinarian or other qualified professional immediately.
If you provide us information about yourself, such as your name and e-mail address, you purchase any of our products or join our email list, we may use your email address to send you service related notices primarily for purchase confirmations and monthly newsletters. If you don't want to receive these messages, you can opt out by following the instruction in the message for unsubscribing. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses. Your information may be used via Visitor Analytics or Google Analytics, but will not be used other than business trends and demographics.
Terms of Sale
Pet Products. Though we use human grade ingredients, our products are intended for pets and not for human consumption.
No Resale. You are not permitted to resell or otherwise use the Products for commercial purposes unless agreed upon.
Payment and Billing Information
By providing a credit card or other payment method that we accept, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable taxes and other charges). If the payment method cannot be verified, it invalid or is otherwise not acceptable, your Order may be suspended or cancelled. You must resolve any problem we encounter in order to proceed with your Order. In the event you want to change, or update payment information associated with your account, you can do so at any time by logging into your account page.
In the event your credit card fails when we attempt to charge, we will promptly notify you and try again periodically. If we cannot successfully charge your card, we reserve the right to not send your Order. If we do send your Order, you are responsible for prompt payment.
Pricing and Availability
All prices are shown in U.S. dollars and applicable taxes and other charges, if any, are additional unless explicitly stated otherwise. We reserve the right to adjust prices as we may determine in our sole discretion, at any time and without notice. We will not be able to notify you of changes in any applicable taxes.
We strive to provide you with high quality Products and given the perishable nature of our Products and conditions beyond our control, we may be required to make substitutions from time to time. With natural ingredients, our Products are subject to availability, and so we may limit quantities or discontinue offering certain Products or to substitute Products.
If there are items out of stock or we are not able to fill your product, or there’s been a drastic price change, we will try and contact you to see if you’d like to substitute for something else or make any changes to the item, provided we have enough time to do so and the availability is not an issue. In this case, no change fee will be imposed (see Changes and Late Orders). You will see an e-gift card sent to your email for those items that are not filled and we are not able to get in touch with you. Please check your emails (spam & junk folders as well) or text messages. No refunds will be issued.
Product Suitability and Health Conditions
Every pet is unique and it is your responsibility to monitor your pet’s reaction to the Product and request any necessary adjustments. Our recommended portion sizes are based on you feeding your pet(s) only our Product and we obviously cannot account for other food or treats that you feed without specific and accurate information from you.
It is your responsibility to verify whether our Products are suitable for your pets and to inform us if your pet has any health issues, including allergies. We are not veterinarians and DO NOT offer veterinary advice. We may provide general guidelines about the suitability of our Product for your pets, but any specific advice on suitability must come from your veterinarian. Consequently, you agree that we cannot have liability associated with any adverse reactions.
Changes and Late Orders
There will be a $25 fee for orders submitted after the ordering deadline to get the same shipping date scheduled.
For example: Ordering deadline is April 28th and scheduled shipping day is May 20th. If you place your order on April 29th or after and still want your order to ship on May 20th the late fee will apply.
There will be a $25 change fee for any changes on orders waiting to be processed and shipped after the deadline.
For example: Ordering deadline is April 28th and scheduled shipping day is May 20th. If you placed your order by April 28th but need to make a product or quantity change to your order before May 20th. There will be a $25 change fee if we are able to make the change. The change fee will not be applicable if we are out of stock or unable to get a product and substitutions need to be made as a result.
Both situations will be subject to product availability.
If an order is cancelled after the ordering deadline that is waiting to be processed and shipped, there will be a 50% cancellation fee based upon the total of your order, including shipping and tax (if applicable).
Return and Refund Policy
Simply Rawsome is not responsible for the product after it leaves the premises or our possession. We will package shipped products the best and most efficient way possible to get a good product to you and work with you to ensure your satisfaction.
If your companion does not like the products we, unfortunately, cannot provide a refund. Due to the perishable nature of the products, we are not able to take returns. We would suggest reaching out to friends, local Facebook groups, or the Simply Rawsome Community Facebook group to see if there is anyone in your area that would like it.
You have 48 hours from when the product is delivered to notify us if there are any issues with your order. After that, there will be no credits or refunds.
Returns will be processed on a case by case basis and are given as a credit to your account.
To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless Simply Rawsome, and our respective past, present and future employees, contractors, consultants, suppliers, vendors, service providers, affiliated companies, other agents and their successors from and against all actual or alleged claims, damages, awards, judgements, losses, liabilities, obligations, penalties,, interest, fees, expenses (including, without limitation, attorneys’ fees and expenses) and costs (including, without limitation, court costs, costs of settlement and costs of pursuing indemnification and insurance), of every kind and nature whatsoever, whether known or unknown, foreseen or unforeseen, or suspected or unsuspected, in law or equity, whether in tort, contract or otherwise (collectively, “Claims”) including, but not limited to, damages to property or personal injury, that are caused by, arise our of or are related to (a) your use or misuse of the Sites, Content or Products (including, but not limited to, human consumption of Products designed for pets, misuse of the Product, or feeding in violation of recommendations), (b) any User Content you create, post, share or store on or through the Sites or our pages or feeds on third-party social media platforms, (c) any Feedback you provide, (d) your violation of these Terms, (e) your violation of the rights of another, and (f) any third-party’s use or misuse of the Sites or Products provided to you. You agree to promptly notify us of any third-party Claims and cooperate with Simply Rawsome in defending such Claims. You further agree that Simply Rawsome shall have control of the defense or settlement of any third-party Claims. This indemnity is in addition to, and no in lieu of, any other indemnities set forth in a written agreement between us.
Special Notice Related to Food Safety
YOU ARE SOLELY RESPONSIBLE FOR THE PROPER AND SAFE HANDLING, PREPARATION, STORAGE, USE AND CONSUMPTION OF THE PRODUCTS YOU RECEIVE FROM US. YOU ACKNOWLEDGE THAT WE HAVE NO LIABILITY WHATSOEVER FOR HUMAN CONSUMPTION OF PRODUCTS DESIGNED FOR PETS. YOU ARE ALSO SOLELY RESPONSIBLE FOR KNOWING ABOUT ANY FOOD ALLERGIES YOU OR YOUR PET MAY HAVE AND VERIFYING THE PRODUCTS AND THEIR CONTENTS BEFORE YOU OR YOUR PET HANDLE, PREPARE, USE OR CONSUME SUCH PRODUCTS.
